Make Me Static - Terms and Conditions of Use

Terms of Service

These terms govern the use of the Internet service known as “Make Me Static” as provided by the UK Company, Mad Penguin Consulting Ltd. This service is provided via a WordPress Plugin and is designed to allow WordPress Administrators to create static versions of their site and to store these versions in a GIT repository. In order to use this service you must agree to and abide by the terms as set out here.

Your Permission to use the Service

You must be an administrator of the site(s) for which you are using this service and are either the owner or have permission from the owner to install the Make Me Static plugin on the site. The service is Free to use unless you explicitly sign up for a paid enhancement and supply card details in order to pay for the service.

If you are using the free-tier service and your site is published via our “pages” platform, then your site must remain available as the “origin” site for the static copy. If you take your site offline, then after a period of time your static copy will expire.

Acceptable Use

The software is designed to crawl the WordPress site onto which the plugin is installed and ONLY that site. By installing the plugin you are implicitly giving the service permission to crawl the site. The “rate” at which the site is crawled and the frequency with which it is crawled are controlled from within the Plugin. You may not use the service to break the law, abuse websites or generally mis-behave. Mis-use of the service may result in your ability to use the service either being suspended or terminated.

You must agree that you are the owner of the website in question or have the permission of the owner to install this plugin. You must also agree that any credentials for third party services that you enter are yours and you give permission for us to use them for the purposes described.

Limits on Liability

The company endeavour to protect sensitive information and keep the service running in a secure manner. Credentials and keys are encrypted at rest and communications take place over either HTTPS or WSS encrypted protocols.

Neither the company, it’s employees or it’s suppliers will be liable to you for breach-of-contract damages, loss of service or loss of data or any consequential loss as far as the law allows. The total liability to you for claims of any kind that are related to this service will be limited to £0.

This service assumes that you will be using ‘free tier’ instances of third party services, for example Git repositories. If you choose to use any non-free services in association with this service, any fees, charges or other liabilities are your responsibility as the account holder. Neither the company, it’s employees or it’s suppliers will be liable for any of these charges.

Termination

If you have upgraded your subscription to a paid option, the minimum initial term is one month. If you downgrade from a paid subscription to a free subscription, the downgrade will happen at the end of the current billing cycle (month). So for example if you upgrade to the LITE product and then downgrade to FREE after two weeks, the service would actually run to the end of the initial 1 month period, and then not renew.

If you upgrade part way through a billing cycle (month), the new service will start immediately and the pro-rata cost of the new service for the part of the month will be added to the next bill. If you downgrade from one paid service to another part way through a billing cycle (month), the new service will start immediately and a pro-rata credit will be added to your next bill for the unused portion of the subscription. After upgrading your account you must wait at least 48 hours before downgrading your account. i.e. the minimum term for an upgrade is 2 days.

Please note that when you downgrade your account, your profiles will be modified to fit within the confines of your new subscription. Notably, if you have created multiple profiles and downgrade to a subscription that supports fewer profiles, some of this profiles may no longer be accessible.

Disputes

The UK will govern any dispute related to these terms or your use of this service. You and the company agree to seek injunctions related to these terms only in a court in UK.

General Terms

If a provision of these terms is unenforceable as written, but could be changed to make it enforceable, that provision should be modified to the minimum extent necessary to make it enforceable. Otherwise, that provision should be removed.

You may not assign your agreement with the company. The company may assign your agreement to any affiliate of the company, any other company that obtains control of the company, or any other company that buys assets of the company related to the forum. Any attempted assignment against these terms has no legal effect.

These terms entirely replace any other agreements about the use of the service, written or not. Neither the exercise of any right under this Agreement, or waiver of any breach of this Agreement, waives any other breach of this Agreement.

Changes

The company last updated these terms on 24 Sep 2024, and may update these terms again. For updates that contain substantial changes, you will be prompted to accept these terms the next time you visit the WordPress Plugin. Once you get notice of an update to these terms, you must agree to the new terms in order to keep using the service.
